Fellow firefighters, over the last 7 months I have learned a lot about the workmans comp courts and in particular the Presumptive Law. As you are aware the city does not like this law at all. They are using out of house atty. to fight these cases in court hoping to win one. I will tell you, you must be patient and let the system work. I was placed on sick leave for 6 months, not OJI but in the end all of my time was returned. (Thank you Peggy) It was not the fire chiefs decision to place me on sick leave but when the city denied me OJI it was the one we had to go with. If you have a legitimate claim the system will work. My atty. was Gary Prochaska law firm, who I will highly recommend, told me from the start that the city would try every thing to win, and they did. If you have to fight the city in the court system do it, but once you start see it all the way through. Again, there are several atty out there that will represent you, talk to a couple then make up your mind, personally I am more than pleased with how my case was handled by Gary.
